The text of these Regulations is as follows:
Article 1
These Rules are established as per Article 22 of the Professional and Technical Personnel Examinations Act ("the Act").
Article 2
The categories of Professional and Technical Examinations stipulated in Article 2 of the Act are shown in the Appendix.
Article 3
The "multi-format examination" in Article 5, Paragraph 1 of the Act refers to examinations that are tested in two or more formats or written processes. The different formatted exam sessions or written processes take place in order. Candidates must pass each previous session before moving on to the next.
The "staged examination" in Article 5, Paragraph 1 of the Act refers to examinations that are tested in two stages, each with its own eligibility requirements. Candidates must meet the eligibility requirements for the stage they sit.
Article 4
Registrations for the professional and technical examination must comply with the method and schedule specified in the examination announcement.
Unless otherwise stipulated in the examination announcement or other law, the following documents shall be submitted for registration:
Registration form.
Copy of ID document.
Proof of exam eligibility.
A 2.5-cm by 3.5-cm close-up photograph showing the head and top of the shoulders. Head coverings should not be worn and the photo should be taken within one year.
Other documentation as required by examination regulations or the authority in charge of examination affairs.
Registration fees must be paid in accordance with the examination announcement and other related regulations before the deadline.
Candidates who fail to register in accordance with the regulations or who fail to submit all required documents and fees are considered to have an incomplete registration process and shall not take the examination. This provision shall not apply where these Rules provides otherwise.
Article 5
Unless otherwise stipulated by examination regulations, candidate qualifications are counted up to the date prior to the examination day.
Candidates who do not meet eligibility requirements or who have been disqualified from taking the examination at the time the examination begins will not be allowed to sit the examination; scores of tested subjects will be cancelled accordingly.
Candidates who do not meet exam eligibility requirements or who are unable to submit eligibility documents at the time of registration may still register to take the examination on the condition that they meet exam eligibility requirements or submit eligibility documents by the examination day and can provide a reason at the time of registration. Candidates may be approved as eligible to take the examination on condition that the reason has been deemed as justified after an eligibility review by the authority in charge of examination affairs.
However, candidates who have been approved to take the examination with conditions but fail to fulfill the requirements will be disqualified from sitting the examination; scores of tested subjects will be cancelled accordingly. Examination fees including registration and material fees will not be reimbursed in this case.
Article 6
Candidates who have not completed a degree program in a public or privately registered university, independent college, two-year college program, or the senior year of a five-year junior college, or who have not completed an equivalent of the above in a foreign nation, China, Hong Kong, or Macau that are recognized by the R.O.C. Ministry of Education, or who have graduated from an experimental program equivalent to senior high school education with documents proving academic credentials may take the junior professional and technical examination under the Act. However, the provision is not applicable if regulations for the specific professional practice or examination provide otherwise.
Article 7
Applications for examination exemptions in accordance with the Act and related exam regulations shall be submitted through the examination registration website with documents proving eligibility and application fees paid as required. Application results will be announced on the examination registration website.
Applicants who meet exemption requirements shall obtain proof of exemption from the MOEX no later than the examination registration deadline. However, if regulations for the specific examination provides otherwise, the examination regulations apply.
Article 8
Candidates registering for the examination or submitting applications under the Act with foreign academic credentials shall provide sufficient documentation that meets Ministry of Education recognition requirements. When necessary, the MOEX may ask registrants or applicants to provide additional eligibility documents.
The following academic credentials awarded by foreign academic institutions do not meet Ministry of Education recognition requirements:
Academic credentials obtained through correspondence.
Academic credentials obtained through distance learning with course credit requirements not meeting Taiwan's requirements for distance learning.
Certificates awarded for completion of training courses, seminars, or workshops.
Doctoral candidate status. Doctoral candidate status will not be recognized as equivalent to a doctoral degree. Doctoral candidates may apply to have their master's degree recognized.
A doctorate conferred after completion of a dissertation, without registration, admission, and taking courses.
Honorary degrees.
An academic credential awarded for programs taught in Chinese in an non-Chinese speaking country or territory.
Academic credentials awarded for completing a degree program offered by a foreign institution with a branch campus in Taiwan or by an institution in Taiwan on behalf of a foreign institution without the permission of the Ministry of Education.
Article 9
Candidates with academic credentials awarded in Hong Kong or Macau shall provide proof of recognition proving the credentials to be in compliance with Regulations Governing the Examination and Recognition of Educational Records from Hong Kong and Macao when registering for the examination or submitting applications under the Act.
Candidates without proof of recognition shall provide documents sufficient for academic recognition when registering for the examination or submitting applications.
Academic credentials will not be recognized if the candidate fails to provide accreditation documentation under the Regulations Governing the Examination and Recognition of Educational Records from Hong Kong and Macao or does not qualify for the recognition requirements. The MOEX may make a request in writing to the competent education authority for determination should concerns or doubts arise in the recognition process.
The following academic credentials awarded by junior colleges or higher educational institutions in Hong Kong or Macau will not be recognized:
Academic credentials obtained through correspondence.
Certificates awarded for completion of training courses, seminars, or workshops.
Doctoral candidate status. Doctoral candidate status will not be recognized as equivalent to a doctoral degree. Doctoral candidates may apply to have their master's degree recognized.
A doctorate conferred after completion of a dissertation, without registration, admission, and taking courses.
Honorary degrees.
Academic credentials awarded after completion of studies at a branch campus outside Hong Kong or Macao.
Academic credentials awarded through distance learning which does not comply with Taiwan's regulations on distance learning or whose distance learning course credits exceed half of the total credits required for graduation.
Article 10
Candidates with an academic credential awarded in mainland China shall provide proof of recognition proving the credentials to be in compliance with Regulations Government the Assessment and Recognition of Academic Credentials Awarded in Mainland China when registering for the examination or submitting applications under the Act.
Article 11
For examination registration or applications using required documents in foreign languages, Chinese translations must be provided. Both original and translated documents shall be verified or certified by the R.O.C. Ministry of Foreign Affairs or its overseas agencies or certified by a public notary. This provision shall not apply where other laws or regulations provides otherwise.
For examination registration or applications by foreign candidates, required documents shall be in Chinese or English. If the documents are in other foreign languages, Chinese or English translations must be provided. Both original and translated documents shall be verified or certified by an overseas mission of the R.O.C. Ministry of Foreign Affairs or, originals shall be verified or certified by the embassy or consulate of the issuing foreign country.
Article 12
The MOEX may create a question creation framework for examination subjects of the professional and technical examinations. Public notice shall be given six months before the examination day in the event of changes to exam subjects. Public notice shall be given four months before the examination day in the event of additional or reduced subjects. The above time restrictions do not apply to amendments made to law titles which are part of the exam subject titles.
Article 13
"Passing by subject" in Article 16, Paragraph 1, Subparagraph 1 of the Act refers to the situation where the examinee passes all examination subjects.
"Passing by total grades" in Article 16, Paragraph 1, Subparagraph 2 of the Act refers to the situation where the examinee’s final grades for all exam subjects passes the minimum threshold.
"Passing by ratio of the total number of fully attending examinees" in Article 16, Paragraph 1, Subparagraph 3 of the Act refers to the situation where the examinee's scores place them within a certain percentage of all examinees who sit for all exam subjects.
Article 14
These Rules shall come into effect upon promulgation.
In case of any discrepancy between the English version and the Chinese version, the latter shall prevail.
