The text of these Regulations is as follows:

 

Article 1

These Regulations are established as per Article 11, Paragraph 1 of the Professional and Technical Personnel Examinations Act.

 

Article 2

Senior Professional and Technical Examination for Public Notaries ("the Examination") is administered annually or biennially.

 

Article 3

The Examination is administered in written format.

 

Article 4

Candidates who meet conditions set out in Article 26 of the Notary Act shall not take the Examination.

 

Article 5

R.O.C. citizens who meet any of the following eligibility requirements may take the Examination:

Have graduated from a department, division, or graduate institute in law, legal studies, jurisdiction studies, financial and economic laws, or government and law at a public or registered private junior college or above in the R.O.C or at a foreign junior college or above recognized by the R.O.C. Ministry of Education.

Have graduated from a public or registered private junior college or above in the R.O.C or a foreign junior college or above recognized by the R.O.C. Ministry of Education, and have taken at least seven of the following courses: Civil Code, commercial law, Company Act, Maritime Act, Negotiable Instruments Act, Insurance Act, Code of Civil Procedure, Non-Litigation Case Act, Bankruptcy Law, Notary Act, Compulsory Enforcement Act, private international law, Criminal Code, Code of Criminal Procedure, administrative law, Securities and Exchange Act, Land Act, intellectual property rights law, Copyright Act, Consumer Protection Act, international trade laws, Anglo-American contract laws, jurisprudence, and legal methodology; a maximum of three credits may be counted for each course for a total of 20 credits or more.

Have passed a junior exam or special exam for court clerks and have worked for four years or longer as court clerks responsible for trial records, finance, civil execution, or as notary clerks, or as clerks in a prosecutors' office responsible for investigation records with documents proving the experience.

Have passed any Qualifying Examination for Senior Examinations in a category equivalent to legal affair personnel category.

 

Article 6

Exam subjects are divided into general and professional subjects:

General subjects:

(1) Chinese (essay)

(2) Constitution of the Republic of China

Professional subjects:

(3) Civil Code

(4) Commercial law

(5) English

(6) The Notary Act

(7) Non-Litigation Case Act and Code of Civil Procedure

(8) Compulsory Enforcement Act and private international law

Exam subjects in the preceding paragraph consist of essay questions. For exam subjects "Code of Civil Procedure" and "Compulsory Enforcement Act", the complete text of these laws will be provided as reference materials.

 

Article 7

When registering, candidates should submit the following documents and fees by mail:

Registration form.

Proof of exam eligibility.

Copy of national identification card. Overseas Chinese should submit their Overseas Chinese Identity Certificate issued by the Overseas Community Affairs Council, or submit their valid R.O.C. passport with approval from an overseas embassy or consulate, representative office, economic and cultural office, or other agency authorized by the Ministry of Foreign Affairs (hereinafter "Overseas Missions") proving them to be R.O.C. nationals residing in a foreign country.

A 2.5-cm by 3.5-cm close-up photograph showing the head and top of the shoulders. Head coverings should not be worn and the photo should be taken within one year.

Registration fee.

Other documents.

Documents and fees for online registrations should be submitted in accordance with guidelines found in the Examination Information Pack and on the MOEX registration website.

 

Article 8

For submissions of overseas documents including diplomas, certificates of degree, academic transcripts, credit verifications, copies of regulations, or other relevant verification documents, original documents must be provided along with Chinese translations and copies of verification from overseas missions or from a domestic public notary. Original copies of the abovementioned documents may be replaced with copies that have been verified to be identical to the original by both a local public notary and an Overseas Mission.

 

Article 9

To pass the Examination, candidates must obtain a final score of 60 points or more.

The final score is the combined score of general and professional exam subjects. The score on the general subjects is the sum of each general subject test score multiplied by 10%; the score on the professional subjects is the average score of all professional subject scores multiplied by 90%.

Exam takers who receive a grade of zero on any exam subject or who receive an average score of less than 50 points on professional subjects will not pass. Absence from an exam session will result in a grade of zero for that subject.

 

Article 10

Article 11

The list of candidates passing the Examination will be submitted by the MOEX to the Examination Yuan for the issuance of qualification certificates and to the Judicial Yuan for reference.

 

Article 12

These Regulations shall come into effect upon promulgation.
